Article 36 – Definition and predominant uses
1 — Depending on their suitability, agricultural and forest lands are divided into the following subcategories:
a) Agricultural land: areas primarily intended for agricultural activities, including soils classified as part of the RAN;

2 — The soils included in these areas may not be subject to any actions that reduce or destroy their potential, except for those covered by exceptions established in general law or those set out in this Regulation, considered compatible with the predominant use, as well as those defined in the Regional Forest Management Plan for the Douro region.

Article 37 – Uses compatible with the predominant one
1 — The following facilities, works, uses, and activities are considered compatible with the predominant use:
a) Facilities supporting agricultural, livestock, and forestry activities;
b) Residential buildings;
c) Facilities for public interest uses and infrastructure;
d) Tourist, recreational, and leisure developments;
e) Special facilities, namely those related to geological resource exploitation, wind farms, hydroelectric or irrigation projects, inert waste landfills, and service/fuel stations located in areas adjacent to roadways.
2 — Constructions, uses, or activities deemed compatible will only be authorized under the conditions defined in the following articles of this section, and provided they comply with Articles 12 and 22 of this Regulation, concerning forest fire protection measures and rural land ecological structure, and also:
a) Do not negatively affect the surrounding area in landscape, environmental, or functional terms;
b) Comply with specific legislation related to protected forest species, namely cork oak, holm oak, and holly;
c) The interested parties ensure the execution and maintenance of all necessary infrastructure, and construction may be denied if it is impossible or inadvisable to implement individual infrastructure solutions.

Article 39 – Residential buildings
1 — Construction for residential purposes is prohibited in forest conservation and production areas.
2 — Construction for residential purposes is allowed in agricultural areas only if it is a single-family home intended for the owner’s own permanent residence and if all of the following conditions are met:
a) The applicant is a farmer responsible for the agricultural operation and the owner of the property where the dwelling is to be built, in accordance with Decree-Law No. 73/2009 of March 31;
b) There is no existing residential building within the same property, nor an alternative location;
c) The property has a minimum area of two hectares;
d) Complies with paragraph 1 of Article 13;
e) Complies with Article 12 regarding fire protection measures;
f) The maximum building facade height is 9 meters, measured from the lowest ground elevation point at the base of the facade;
g) The maximum number of above-ground floors, including set-back floors, is two;
h) The land use index (Iu) is 0.02, impermeable area not exceeding 200 m², and if located within the protection zones of the Régua or Carrapatelo reservoirs, the building footprint must not exceed 300 m²;
i) The construction must face a public road, with a minimum 20-meter frontage.
